govern your use of the K53 Exam Preparation platform operated by K53 Exam Preparation

"our").
By creating an account or using our platform, you agree to be bound by
these Terms. If you do not agree, please do not use our platform.
1. The Service
K53 Exam Preparation is an online platform that provides practice examinations
for various topics and qualifications. We provide these exams for
practice and preparation purposes
only. Completion of a practice exam on our platform does not
constitute passing or qualifying for any official examination, licence
or certification.
2. Account Registration
To access paid exams you must create an account. By registering you agree to:
- Provide accurate and truthful information during registration.
- Keep your account credentials confidential and not share them with
any other person.
- Notify us immediately if you become aware of any unauthorised use
of your account.
- Be responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that provide false
information or violate these Terms.
3. Purchases and Exam Access
When you purchase an exam you are purchasing a licence to access that
exam for the stated access period from the date of purchase. The following
conditions apply:
- Access is granted to your account only and is non-transferable.
- You may attempt the exam an unlimited number of times within the
access period.
- Once the access period expires, access is revoked and you would need
to purchase again.
- All prices are displayed in South African Rand (ZAR) and are inclusive
of any applicable taxes.
- Payments are processed by PayFast. By purchasing you also agree to
PayFast's terms and conditions.
4. Refund Policy
Due to the digital nature of our products, all sales are
final and non-refundable
once exam access has been granted. If you experience a technical problem
that prevents you from accessing an exam you have purchased, please
contact us and we will investigate and remedy the issue.
5. Intellectual Property
All exam content, questions, answers, images and materials on K53 Exam Preparation
are the intellectual property of K53 Exam Preparation or our content licensors.
You are granted a limited, non-exclusive, non-transferable licence to
access and use the content solely for personal study purposes.
You may not:
- Copy, reproduce, distribute, publish or share exam questions or
answers by any means.
- Screenshot, record, or capture exam content in any form.
- Use exam content for any commercial purpose.
- Attempt to reverse-engineer, scrape or extract content from our
platform.
Violation of these conditions may result in immediate termination of your
account and may give rise to legal action.
6. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose.
- Attempt to gain unauthorised access to any part of our platform
or its underlying systems.
- Interfere with or disrupt the operation of the platform.
- Use automated tools, bots or scripts to access or interact
with the platform.
- Attempt to bypass or circumvent any content protection measures
on the exam pages.
7. Disclaimer of Warranties
The platform and its content are provided on an
"as is" and
"as available" basis
without any warranties of any kind, express or implied. We do not warrant
that the platform will be uninterrupted, error-free or free of viruses
or other harmful components. We do not guarantee that practice exam
results will predict performance in any official examination.
8. Limitation of Liability
To the maximum extent permitted by applicable law, K53 Exam Preparation shall
not be liable for any indirect, incidental, special or consequential
damages arising from your use of or inability to use the platform,
including but not limited to loss of data, loss of revenue or failure
to pass any official examination.
9. Governing Law
These Terms are governed by and construed in accordance with the laws
of the Republic of South Africa. Any disputes arising from these Terms
shall be subject to the exclusive jurisdiction of the courts of South Africa.
10. Changes to These Terms
We reserve the right to update these Terms at any time. When we do, we
will update the version number and effective date above. Your continued
use of the platform after any changes constitutes acceptance of the
updated Terms.
